Terms and Conditions

These Terms and Conditions govern the use of the GT AUCTION website, bidder accounts, participation in online auctions, payments, vehicle purchases, collection and related services.
By registering for an account, participating in an auction or purchasing a vehicle through GT AUCTION, you agree to these Terms and Conditions together with the applicable Rules of Auction and any terms displayed for a specific auction or vehicle.
Where auction-specific Rules of Auction apply, bidders should read those Rules before placing a bid.
1. ABOUT GT AUCTION

2. REGISTRATION AND BIDDER APPROVAL
Users wishing to bid must create an account and provide the information and supporting documentation required by GT AUCTION.
This may include identity, contact, address, company, representative and other information necessary to verify the bidder’s identity and authority.
A bidding account will only be activated once the required documentation has been received and verified and the applicable refundable bidding deposit has been received in cleared funds.
GT AUCTION may decline, suspend or delay bidder activation where information or documentation cannot reasonably be verified.
3. REFUNDABLE BIDDING DEPOSIT
A refundable security deposit of R5,000.00 is currently required before a bidder’s account is activated.
The deposit is security for the bidder’s obligations and is not a participation fee.
If the bidder does not become a Buyer and owes no amount to GT AUCTION, the deposit will be refunded to a verified bank account held in the registered bidder’s name within 7–10 Business Days after receipt of a complete refund request.
No cash refund or refund to an unrelated third party will be made.
If a bidder becomes a Buyer, the deposit may be applied towards the invoice or retained as security until applicable payment, documentation, collection and storage obligations have been fulfilled.
Where a Buyer defaults on a binding sale, GT AUCTION may, to the extent permitted by law, set off the deposit against amounts lawfully due, including reasonable and documented cancellation, storage, transport, recovery, resale costs or any proven shortfall on resale.
Any remaining balance will be refunded. Any lawful shortfall remains payable by the Buyer.
4. BIDDING AND BINDING SALES
Before bidding, users must review the vehicle information, photographs, disclosed condition, auction information and applicable Rules of Auction.
Where a bid is accepted in accordance with the applicable Rules of Auction, the sale is binding.
A bidder requiring finance, insurance, transport, repair approval or another third-party approval must arrange this before bidding.
Unless expressly stated otherwise for a particular lot, a purchase is not conditional upon the Buyer obtaining finance or any other third-party approval.
5. VEHICLE CONDITION
Vehicles offered through GT AUCTION may include used, accident-damaged, recovered and salvage vehicles.
A vehicle may be damaged, incomplete, unsafe, non-running or not roadworthy.
Bidders should carefully review the lot information, photographs and available documents and inspect the vehicle where inspection is available before placing a bid.
Any condition, mileage, keys, documentation, roadworthiness, starter status or other vehicle information should be assessed according to the information expressly provided for that particular lot.
Nothing in these Terms excludes rights or liability that may not lawfully be excluded.
6. PURCHASE PRICE AND FEES
The winning bid may not be the final amount payable.
The Total Purchase Price may include:

+ Any clearly disclosed lot-specific charges
+ VAT where applicable
= TOTAL PURCHASE PRICE
The applicable fees and VAT treatment will be displayed before a bid is confirmed and itemised on the Buyer’s invoice.
Document handling or administration charges do not automatically include licensing, registration, change of ownership, police clearance, transport, towing, repairs, keys, batteries, tyres, roadworthy testing or other services unless expressly stated on the relevant lot page.
7. INVOICES AND PAYMENT
The invoice will be issued to the registered bidder who placed the successful bid.
The Buyer must pay the Total Purchase Price in South African rand by the deadline shown on the invoice.
Unless the invoice expressly states otherwise, payment is due by 16:00 on the third Business Day after the invoice is issued.
Proof of payment does not constitute payment.
Payment is complete only once cleared, unconditional and irreversible funds are available in the bank account specified on the invoice.
Payment must be made using [ACCEPTED PAYMENT METHODS] and the exact invoice reference.
GT AUCTION may require verification of suspicious, unmatched or third-party payments.
8. PAYMENT DEFAULT
If payment is not completed by the applicable deadline, GT AUCTION may, subject to applicable law and the Rules of Auction:
• Suspend the bidder’s account;
• Withhold release of the vehicle;
• Issue a breach notice;
• Cancel the sale;
• Resell the vehicle;
• Apply the bidding deposit against amounts lawfully due; and
• Recover reasonable proven losses and enforcement costs.
GT AUCTION may not recover the same loss twice.
9. VEHICLE RELEASE
Ownership will pass only after full cleared payment and satisfaction of all applicable sale requirements.
No vehicle, keys or original ownership documents will be released until all amounts lawfully due have been paid and all required identity, authority and vehicle documentation has been verified.
GT AUCTION may withhold release while a payment is reversed, disputed, subject to chargeback or reasonably suspected of fraud.
10. COLLECTION
Once full cleared payment and required documentation have been verified, GT AUCTION will issue a Release Note containing the vehicle details, collection location, issue time and Collection Deadline.
The Buyer must ensure that the vehicle physically leaves the yard by 16:00 on the third Business Day after the Release Note takes effect.
If the Release Note is issued before or at 16:00 on a Business Day, the next Business Day is Day 1.
If the Release Note is issued after 16:00 or on a non-Business Day, it is deemed to have been issued on the next Business Day.
The Buyer must comply with GT AUCTION’s collection procedures and provide the required Release Note, identification and supporting documentation.
11. TRANSPORT AND SAFETY
Collection, loading, towing, permits, insurance and transport are the Buyer’s responsibility and cost unless a written transport service has been purchased from GT AUCTION.
No repair work may be performed in the yard without written permission.
A vehicle described as damaged, salvage, non-running, non-roadworthy or otherwise unsafe may not be driven from the premises and must be removed using appropriate lawful transport.
Assistance provided by yard staff does not constitute a representation that a vehicle is safe, roadworthy or suitable to drive.
12. STORAGE CHARGES
If a vehicle has not physically left the yard by the Collection Deadline, a storage charge of:
R[STORAGE RATE] [INCLUSIVE / EXCLUSIVE] OF VAT PER VEHICLE PER DAY OR PART THEREOF
will accrue from 00:01 on the next Business Day until and including the day on which the vehicle leaves the yard.
Accrued storage charges and other amounts lawfully due must be paid in cleared funds before release.
Storage will not be charged for a period during which collection is impossible solely because GT AUCTION has not issued or cannot honour a valid Release Note for reasons not caused by the Buyer, collector or transporter.
If the yard is unexpectedly closed during published collection hours, the applicable collection deadline will be extended by the affected period.
13. THIRD-PARTY COLLECTION
A Buyer may authorise a tow operator or other representative to collect a vehicle on the Buyer’s behalf.
Third-party collection requires GT AUCTION’s approval of a completed Third-Party Vehicle Collection Authorisation and Designation together with the required supporting documentation.
This may include:
• The applicable Release Note;
• A signed copy of the Buyer’s identity document, certified if required;
• The collector’s original identity document;
• Transport or towing details; and
• Where the Buyer is a company or other juristic person, proof that the person providing the authorisation has authority to do so.
GT AUCTION may verify the instruction directly with the Buyer using the Buyer’s registered contact details.
Incomplete, inaccurate or inconsistent documentation may delay or prevent release.
14. UNCOLLECTED VEHICLES
Where a Buyer has not paid or collected a vehicle, GT AUCTION may exercise the remedies available for payment default, subject to applicable law and the applicable Rules of Auction.
Where a vehicle has been fully paid but remains uncollected, GT AUCTION may issue reminders and a final written notice.
After [10 BUSINESS DAYS] written notice, GT AUCTION may move the vehicle to a secure third-party storage facility at the Buyer’s reasonable actual cost and risk, subject to applicable law.
Non-collection does not itself transfer ownership of a paid vehicle to GT AUCTION.
Any sale, disposal or other dealing with a fully paid but uncollected vehicle will only take place under a valid written authority, court order or other lawful process following appropriate notice.
15. FRAUD AND BANK DETAILS
Buyers must use only the payment details contained on an official GT AUCTION invoice or approved customer portal.
GT AUCTION will not communicate a change of bank details solely by email, SMS or WhatsApp.
Any request to change payment details should be independently verified using the telephone number published on the official GT AUCTION website.
Nothing in this clause excludes liability that cannot lawfully be excluded.
16. PERSONAL INFORMATION AND POPIA
GT AUCTION processes personal information in connection with account registration, identity verification, bidding, payments, refunds, vehicle release, collection, fraud prevention, recordkeeping and legal compliance.

Marketing consent is optional and is treated separately from information necessary to operate a bidder account or complete an auction transaction.
17. BUSINESS DAY
For purposes of these Terms, “Business Day” means a day other than a Saturday, Sunday or South African public holiday on which the relevant GT AUCTION collection yard is open for its published ordinary collection hours.
Saturday does not count as a Business Day for purposes of these Terms unless expressly stated otherwise.
18. RULES OF AUCTION
Every auction is also subject to the applicable Rules of Auction.
Bidders must review the applicable Rules of Auction before participating in an auction.
Auction-specific Rules may contain additional information regarding the auctioneer, auction house, auction format, reserve price, bidding procedures, fees, vehicle particulars and other conditions applicable to that auction.
Where required, the Rules of Auction will be made available before the auction in accordance with applicable South African law.
19. APPLICABLE LAW
These Terms and Conditions and the use of the GT AUCTION service are subject to the laws of the Republic of South Africa.
Nothing in these Terms is intended to exclude, restrict or waive any right or liability that cannot lawfully be excluded or restricted.
